What is collaborative practice?
Collaborative practice is a way of a couple and their respective lawyers meeting and sitting round a table together to resolve the issues that arise upon divorce, separation or dissolution of a civil partnership. It operates without involvement of the Court, other than where necessary to approve the terms of any agreement reached through the means of the collaborative process. Each person has their own lawyer to guide and advise them throughout the process but the lawyers take care not to become adversarial or score points against each other, to ensure that the agreement achieved is the best possible solution for the couple and their family.
At TWM, we have four people in our Family and Matrimonial team who are trained collaborative lawyers.
Collaborative lawyers sign an agreement with the client that prevents them from representing either party in court if the collaborative process breaks down. This means that the solicitors are absolutely committed to helping their clients to find the best solutions by agreement, rather than through a more adversarial approach.
