Patrick Stewart, Partner in Employment Law
Patrick is a Partner in the Employment Law and HR team. He qualified as a solicitor in 1984 and became a Partner in 1990. He advises both employer and employee clients with all aspects of employment law, in particular claims to enforce and to challenge the enforceability of post-termination restrictions and confidentiality clauses in contracts, claims for breach of contract including post-termination restraints, unfair dismissal, claims for discrimination, advising on redundancies, overseeing disciplinary and grievance hearings, negotiating termination arrangements, Settlement Agreements and general employment advice.
He is a regular advocate before Employment Tribunals. Particular cases of note to include:
Successfully challenged enforceability of post-termination restraint allowing a management consultant to join competitor.
Sean Hanna Limited – successfully enforced non-compete post-termination restriction against ex-employee who had joined a competitor.
Pedder Properties Limited - successfully obtained an injunction to restrain an ex-employee working for a competitor company.
Garage Door - successfully defended Company against claims brought by its former Managing Director.
Shilton - dismissal of Managing Director and hard fought wrongful dismissal claim which had implications for a shareholding in the employer company.
Pipex - negotiated Company away from liability for senior employee who had breached confidentiality obligations to previous employer.
Malook - claim for trader against LIFFE employer achieved award for £500,000 damages.
Bristow - claim against director for fraud, secured damages of c£1m, involved Freezing Injunction.
Bain v Bowles (The Lady) - claim for discrimination. Referred to Court of Appeal. Reported.
He is a member of the Employment Lawyers Association. Patrick was Managing Partner of TWM in two separate stints, totalling 10 years, until stepping aside in July 2013.
Patrick's interests include the study of ancient Celtic civilizations and modern British and American politics.
