The recent ruling that a baby girl should live with her biological father instead of her birth mother, underlines the need for clear written agreements where there is a sperm donor or surrogacy situation. The father said that the mother had agreed to act as a surrogate for himself and his same sex partner. The mother said that the father had agreed to be a sperm donor. The judge found that it was intended that there should be a surrogacy arrangement and that the baby girl should live with the biological father and his partner.
